Terms and Conditions for Cremated Remains Scattering Services

Grand Canyon Burial 

1. Service Scope and Limitations
The Company provides services for the scattering of cremated human remains (hereinafter "remains") in authorized locations in the Grand Canyon region (excluding Grand Canyon National Park, Bureau of Land Management, National Parks Service, and Lake Mead Conservation Area.). The Client acknowledges that scattering is prohibited inside the National Park. The Company will only perform scatterings on private property with written landowner permission or in designated public lands where legal.

2. Authorizing Agent Warranty
The client ("Client") warrants they are the legal next-of-kin or authorized agent for the deceased and have legal authority to dispose of the remains. The Client certifies the remains provided are solely cremated human remains.

3. No Refunds and Final Sales
All sales are final. Once a contract is signed and payment is made, no refunds will be issued for any reason, including but not limited to:

  • Cancellation by the client.

  • Inability to scatter at a specific, requested location that is prohibited by law, such as within Grand Canyon National Park, Bureau of Land Management, National Parks Service, and Lake Mead Conservation Area.

  • Weather-related delays or inability to perform the service on a specific date. In such cases, the service will be rescheduled, not refunded.

4. Liability and Indemnification
The Company is not liable for loss or damage to the container holding the remains during transport. The Client agrees to indemnify and hold harmless the Company from any claims, legal fees, or damages arising from the scattering of the remains, including, but not limited to, unauthorized scattering by client request, unexpected weather conditions, or environmental factors.

5. Environmental Compliance
The Company will follow "Leave No Trace" principles, leaving no urns, markers, or identifying tags, consistent with NPS guidelines.

6. Governing Law
This agreement is governed by the laws of the State of Arizona and Nevada.

The Client acknowledges and agrees to these Terms and Conditions.

Having said that, Terms and Conditions (“T&C”) are a set of legally binding terms defined by you, as the owner of this website. The T&C set forth the legal boundaries governing the activities of the website visitors, or your customers, while they visit or engage with this website. The T&C are meant to establish the legal relationship between the site visitors and you as the website owner. 

 

T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on).     

 

T&C provide you as the website owner the ability to protect yourself from potential legal exposure, but this may differ from jurisdiction to jurisdiction, so make sure to receive local legal advice if you are trying to protect yourself from legal exposure.

Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
